Terms and Conditions of Sale

The present general conditions of on-line sales shall be applicable between the company Etrictor S.L. [Limited Liability Company], legally constituted in Spain with Fiscal Identity Number B-25701202 and registered in the Trade Registry of Lleida [Spain] on the 18th day of December of 2009 under the following registry data: T 1218, F 20, S 8, H L 24286, I/A 1 (20.01.10), (hereinafter "lookat.com") and any person (hereinafter "the client") who carries out a purchase through the web page www.lookat.com, (hereinafter the "web page").

The client does hereby declare and assure to be of full legal age and to have the necessary legal capacity to purchase in the web page: www.lookat.com.

Either navigating through the web page, or buying any of the products offered in it, means the acceptance by the user, without reservations of any type, of all and every one of the present general conditions of trading and use. In case of modification by lookat.com, the applicable conditions to every customer shall always be the ones he/she accepted when carrying put his/her sales.

To make an order it is necessary to connect to www.lookat.com, and to access to the purchase of products, the costumer should add the product he/she wishes to buy to the basket. Once the product has been added to the basket, the customer can ask for a budget of the costs of the purchase and its shipment. To formalize the purchase, the client must register as user or access as guest, by filling the electronic application form which appears at every moment and following the instructions indicated in it.

The validation of the order by the customer means the express knowledge and acceptation of the present trading general conditions. Except otherwise proved, the data registered by lookat.com prove the group of transactions carried out by the customer. Once carried out the purchase and within the following three working days, the customer shall receive an e-mail with the purchase data.

The prices fixed in the web page are shown in Euros, VAT included. According to the current laws, any purchase carried out through the web page shall be subject to VAT, except in the planned exclusion cases.

The haulage contractor shall deliver the order in the given delivery address at the moment of the purchase and which can be different of the invoicing address. It is possible to monitor the delivery process of the order with the number of the delivery note, in the web page of the chosen haulage contractor:

The delivery period of the order is shown approximately in the order, and shall also appear in the email of expedition of the order. This delivery period depends on the requested articles, as well as the delivery address, and shall be approximately provided during the delivery process. In any case, lookat.com commits itself to ship the order to the customer within 7 days.

The delivery/management costs are not included in the price and shall be shown before finishing the purchase, according to the delivery address of each order and/or in the moment of asking for the budget of the purchase.

All order to be delivered outside the Continental European Union, can be subjected to taxes, fees and/or custom rights. These taxes, fees and/or rights are not included in the price and shall be paid by the customer. Lookat.com does not have the obligation to verify and inform the customer about such taxes, fees and/or rights, so we advise the customer to get this information previously.

For the payment of the purchase, the customer shall be redirected to the web of the selected payment service:

• For payments through Paypal: www.paypal.com
• For payments on installments through 1EUROCOM: www.1euro.com

By the acceptation of the present general conditions, you also accept the conditions of the web of the selected payment method as well as the ones of the chosen haulage contractor.

Lookat.com shows with as much precision as possible the characteristics of the products, even though the costumer must take into consideration that there may be small differences between the interpretation of the product in the web page and the physical product, which makes the costumer having the possibility of give up his/her purchase according to what establishes the sixth clause.

Lookat.com reserves the right to modify the commercial offer (products, prices, promotions and other commercial and service conditions) presented in www.lookat.com at any time. We do all efforts to offer the information contained in the web truthfully and without typographic errors. In case at any time such errors appeared, for reasons beyond the control of lookat.com, they’d be immediately corrected. If there exists a typographic error in any of the shown prices and any customer had took a purchase decision based in the mentioned error, we’ll communicate him/her about such mistake and he/she shall have the right to cancel his/her purchase without any costs. It is also possible that the contents of the web site show, occasionally, provisional information about some products. In the case such information does not correspond to the characteristics of the product, the customer shall have the right to cancel the purchase without any costs.

The customer undertakes the following conditions, without limiting the list:

1. To fulfill the present general conditions and to act always according to the law and in good faith.
2. Not to introduce or to spread from the web page, any information or material which is defamatory, slanderous and obscene or, in general, which violates the laws or the existing regulations.
3. To make a good and correct use of the web page, fulfilling all the time the existing laws or regulations, as well as the rules of good faith and the proper commercial uses of the sector.
4. To warrant the veracity and accuracy of all the data and other information introduced in the web page and to bring them up to date.
5. To make sure his/her password and user data introduced to access the web page, shall not be used by third parties.
6. To refrain from doing anything that may affect or damage the computer systems, equipments and services of the web page.

The presented products in the web page fit in the Spanish laws. The responsibility of lookat.com cannot be invoked in the case of the products not fitting to the laws of other countries where they may have been sent to according to an order from the customer. The customers from outside Spain must verify the possibility of importing or using the requested products.

The customer makes at his/her own risks all the transactions through the web page and, therefore, assumes all the responsibility resulting from the use of the web page, being the sole responsible of all direct or indirect effects on the web page.

Lookat.com is not responsible, neither directly nor indirectly, of any information, contents, assertions and expressions contained in the commercialized products in the web page. Such responsibility goes all the time to the editors or distributors of such products.

Lookat.com uses all the available resources to offer the most advanced security systems to protect its systems and the data of the users, against deliberate acts of virus or hackers. Nevertheless, the customer understands and accepts the open, world-wide and decentralized nature of internet and therefore, the intrinsic risks of the transactions made through this mean, renouncing to any claim against lookat.com to this effect.

Lookat.com does not held any responsibility for the prejudices derived from interferences, omissions, interruptions, computer virus, damages and/or disconnections in the operative working of this electronic system or in the machines and computer equipments of the users, caused by any reason beyond the control of lookat.com, that prevent or delay the provision of the services or the navigation through the web page, neither the delays or jamming in the use caused by faults or overloads in Internet or in other electronic systems, neither of the impossibility of providing any service or to allow access for causes non attributable to lookat.com, because of the user, third parties or force majeure causes.

The customer can desist freely the contract within the period of seven (7) days from the date of the product's delivery.

In case of the withdrawal taken place before the product has been sent to the customer, the amount previously charged to the customer shall be refund, within the first thirty (30) days from the moment the withdrawal was received.

In case the product had already been sent, the period for the right to withdrawal shall be calculated from the day of the reception of the product. Once the order returns to our warehouse, and once checked that both the conditioning and the returned product/s are in perfect conditions, the customer shall be refunded the amount of the purchase price, within the 30 days from the moment the withdrawal was received. In this case, the customer service shall coordinate the collection of the articles in the domicile of the customer, and once arrived to our warehouse, the returned articles shall be checked and if everything is correct, that is, that they’re properly packed and preserve all their original accessories and instructions and that they’re in perfect conditions, the amount shall be refund through the same payment system used by the customer.

The price to be refund is the one that originally appeared in the order, except the product return costs to lookat.com, which shall only be refund in case of lookat.com being responsible of the cause of the product return. Once verified the proper state of the returned product, lookat.com shall proceed with the refund of the amount within the 30 first days from the moment in which the withdrawal was received.

The products have a guarantee of two years according to the following regulations: (Minimum 2 years)

1. Lookat.com offers a guarantee for all defects arisen during the guarantee period and which are not attributable to a defect of the material or to a manufacturing defect.
2. They are excluded from the guarantee:
   • The products subject to a wearing away conditioned by the use or another natural wearing away,
   • The defects of the product attributable to a lack of observation of the use warnings, to an improper use, to abnormal environmental conditions, improper use conditions, overload or an inadequate maintenance or conservation,
   • The defects of the product caused by the use of accessories, extra pieces or non original spare parts,
   • In general, the defects of products that cannot be attributable to lookat.com or which are attributable to the customer,
   • Discreet divergences of the prescribed state which are not important for the value and the suitability of the product.
3. The elimination of the admitted defect by lookat.com as obligation of the guarantee can take place via a free repair of the defective product or through the substitution by a new product. The substituted products or pieces become our property.

5. In case of defective product from origin, once lookat.com receives the defective product, it shall send another product to the customer. In this case, the change shall be always for the same article or reference. Only the first delivery shall be invoiced, paying lookat.com the corresponding expenses to the devolution and new consignment. If the customer wants to change it for another article, the devolution and new consignment expenses shall not be assumed by lookat.com.

Lookat.com is the holder and license of all the rights of Intellectual and Industrial Property of all the contents published in the web page and specially the designs, texts, graphics, logos, icons, buttons as well as the software and whatsoever other signs which can have an industrial or commercial use. It is forbidden to assign, distribute, transfer, storage or communicate either partially or totally the contents of the web page.

For the process of registering in the offered services which require previous subscription of identification, it is necessary to compile certain personal data of the user. Lookat.com guarantees the proper use of the personal data and commits itself to respect its confidentiality. The personal data provided by the user shall be confidential and shall become part of the file "Customers", which purpose is the formalization of the sales and the sending of information about the articles, services and promotions of lookat.com, and the customer can use the right of access, rectification, opposition and cancelation in respect of the data contained in this file, according to the Organic Law 15/1999, of 13th December, of Protection of Personal Data and other regulations developed, communicating it in writing through the following e-mail address security@lookat.com

We inform the customer that the web page uses devices of implantation of cookies and storage of IP. The cookie is a file we deposit in your computer with the only purpose of simplifying your navigation through www.lookat.com. In any case, the client can configure his/her navigator to be informed about the reception of cookies and prevent its installation in the hard disk.

The sales made in www.lookat.com are submitted to the Spanish Laws. In the case of any conflict or disagreement in the interpretation or application of the present general conditions, the Courts and Judges which shall try the case are the ones which provide the applicable legal regulations as competent jurisdiction, which is, being final consumers, the place of the fulfillment of the obligation or the one of the domicile of the buying part.

In the case of the buying part residing outside of Spain, both parties submit themselves, renouncing expressly to any other jurisdiction, to the Courts and Judges of Barcelona (Spain).
